TITLE: REGISTERED VICTIM NOTIFICATION
EFFECTIVE DATE: February 15, 2017
POLICY: The Sheriff's Office Victim Services Coordinator shall notify properly
registered victims or designated family members of actions concerning those accused or convicted in accordance with the Louisiana Crime Victims Reparations Act.
Intake/Booking staff shall make/attempt notifications prior to the offender's release.
DEFINITIONS:
- Victim (46:1842): 1. A person against whom any of the following offenses (or the attempt of the following offenses) have been committed:
- Any homicide, or any felony offense defined or enumerated in as a crime of violence in R.S. 14:2(13);
- Any sexual offense;
- The offenses of vehicular negligent injuring and first degree vehicular negligent injuring.
- Releasing Authority: The staff member in Intake/Booking authorizing the release and documenting the information.
- Crime of Violence (14:2.13): An offense that has, as an element, the use, attempted use, or threatened use of physical force against the person or property of another, and that, by its very nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense or an offense that involves the possession or use of a dangerous weapon.
The following enumerated offenses and attempts to commit any of them are included as crimes of violence:
Solicitation for murder, first degree murder, second degree murder, manslaughter, aggravated battery, second degree battery, aggravated assault of a peace officer with a firearm, mingling harmful substances, aggravated rape, forcible rape, simple rape, sexual battery, aggravated sexual battery, intentional exposure to AIDS virus, aggravated kidnapping, second degree kidnapping, simple kidnapping, aggravated arson, aggravated criminal damage to property, aggravated burglary, armed robbery, first degree robbery, simple robbery, purse snatching, extortion, assault by drive-by shooting, aggravated crime against nature, carjacking, illegal use of weapons or dangerous instrumentalities, terrorism.
RULES:
- When a person is deemed a victim, as defined in this policy, and an arrest is made, the arresting/transporting officer shall immediately send one copy of the completed Victim Notice and Registration Form to the facility.
- The Intake/Booking releasing authority shall use the information provided to attempt to notify the victim prior to the offender's release from custody. C. Victim notification shall be performed regardless of the fact that an offender is to be transferred or committed to another detention or correctional facility. Only written notification shall be provided in such instance due to security concerns during the transport.
- When an offender is transferred or committed to another detention or correctional facility, Intake/Booking staff shall ensure that the Victim Notice and Registration Form is provided to the transporting officer.
- Victim notification shall be required in cases of improper release or escape. Follow-up notification to the victim(s) shall occur when the improper release or escapee is returned to custody. F. Facility staff shall follow procedures in accordance with Sheriff's Office guidelines when notifying the designated family member of deceased, seriously injured or seriously ill persons.
