TITLE:       SEXUAL HARASSMENT POLICY

RESCINDED:  February 15, 2017 

EFFECTIVE DATE: APRIL 26, 2022

                                                       

This policy is established by the this Department in regards to Sexual

Harassment.

 

  1. DEFINITION:

 

SEXUAL HARASSMENT: Sexual harassment is considered a type of discrimination. It is defined as unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature when:

 

  1. Submission to such conduct is, either implicitly or explicitly, a term or

condition of employment.

 

  1. Submission to or rejection of such conduct is used as the basis or

Employment or job assignment decisions; or

 

  1. The conduct has the purpose of effect of unreasonably interfering with an Individual's work performance or creating an intimidating, hostile, or offensive working environment.

 

  1. Maintaining close proximity to an individual, staring, leering or any other Form of nonphysical act or conduct has the purpose or effect of creating an intimidating, hostile, or offensive work environment.

 

  1. Physical touching in any form without consent.

 

  1. Verbal comments, "jokes" or any form of communication in the work place

involving sexual matters.

 

  1. REPORTING PROCEDURES:

 

  1. Evangeline Parish Sheriff's Department, will not tolerate any form of sexual harassment. Any employee who experiences or observes any act of sexual harassment should immediately report the incident to his or her immediate supervisor or any staff member to who he or she may feel more comfortable reporting the incident.

 

  1. In all cases the strictest confidence of all reports must be maintained and all Initially investigated under the direction of the division director or if circumstances warrant, the department supervisor. All confirmed incidents will be reported to the Criminal Investigation Department or department or person as authorized by the Sheriff for further evaluation and disposition.

 

 

  1. MANDATORY TRAINING:

 

  1. All employees, including part-time employees and members of the Evangeline Parish Sheriff's Office are required to complete the online course or Instructor Led training in LEO "Preventing Sexual Harassment" by December 31st each year.

 

  1. Anyone who supervises employees or any employee who may receive or investigate a sexual harassment complaint is required to receive additional education and training each year by December 31st. The additional education and training may be received either in person or through an online course approved by the Administrator or the Sheriff.

 

  1. The Administrative Coordinator for Human Resources shall maintain records of compliance for each employee of the agency.

 

  1. Failure to complete the mandatory training requirements may result in disciplinary action, up to and including termination.

 

 

 

In regards to: All Rules, Regulations, Policy & Procedures and Special Orders are at the discretion of the Sheriff based on departmental need and the severity of the infraction.
